5. To whom we disclose your personal information?
To achieve the above objectives, the Company uses the services of various contractors.

Some of them are data handlers themselves, such as Google and Facebook. Other contractors have a processor function regarding your personal information.

Other contractors are third parties whose purpose is not to process data, but who may have access to it when performing their tasks or interacting with the Company, such as technical maintenance companies, financial or statutory auditors.

The above personal data may also be made available or provided to third parties in the following situations: (i) to public authorities, auditors or institutions responsible for inspecting business or Company property, who require the Company to provide information, based on its legal obligations. Such public authorities or institutions may be: (ii) for the purpose of fulfilling legal obligations or protecting rights and property of our company or other entities or persons, e.g. courts; (iii) third-party acquirers, to the extent to which the business of the company is (entirely or partially) transferred, and the natural persons’ data is a part of the property subjected to the transfer. Then, for the above processing purposes, we may share your personal information with the OMV Petrom Group companies, the companies that will follow Company's instructions regarding the processing of your personal data.

Persons and entities with whom we may share personal information are as follows:

a. For the purpose of searching the content of the website and for purposes related to the use of cookies, we may send personal information to analysts and search engine owners, in order for them to perform the maintenance of our website;

b. to answer your questions, requests or complaints, we may share your personal information with our service providers (including call centres);
c. For organizing and managing promotional campaigns, as well as for analysing their effectiveness, we may send your personal information to advertising and marketing agencies, digital and social media agencies, and other data processing entities;

7. Processing of data on children under 18
All types of personal data processing presented here apply exclusively to persons who are at least 18. A prerequisite for use of the system and processing results for children between 14 and 18 is consent of a parent/guardian, and is prohibited for children under 14, except if these children have obtained consent of their parent/guardian. In cases when such processing occurs despite our reasonable efforts to prevent it, we shall abort it upon becoming aware that the users are younger than the aforementioned age.

9. The rights of data subjects
Within the context of processing your personal data, you have the following rights:

a. The right to access the personal data being processed: you have the right to a certificate showing if your personal data is being processed or not, and if the answer is yes, to receive a notification specifying the type of personal data and the conditions of their processing, by sending such request to the data operator;

b. The right to request correction or erasure of personal data: you have the right to ask, by sending such request to the data operator, a correction of incorrect personal data, supplementing the incomplete data and erasure of your personal data if (i) the data is no longer necessary for its original purpose (and there is no new legal purpose), (ii) when the legal grounds for the processing is consent of a person who is the data subject, and the data subject has withdrawn their consent and there is no other legal ground remaining, (iii) the data subject has used their right to objection, and the operator has no grounds for continued processing that would have precedence, (iv) data has been processed in an illegal manner, (v) erasure is necessary for the reasons of compliance with the legislations of EU or Romania, or (vi) data has been collected in relation to information society services offered to children (if applicable), where specific requirements apply with respect to consent;

c. The right to request suspension of processing: you have the right to a suspension of processing if: (i) it is your opinion that the processed personal data is incorrect, during a period which enables the operator to check the accuracy of personal data; (ii) processing is illegal, but you do not want us to erase your personal data, but rather to suspend data use; (iii) if the data operator no longer needs your personal data for the above purposes, but you need data for submission, realization or defence from court disputes, or (iv) you have made an objection to the processing and waiting for a decision whether the legitimate grounds of the data operator has precedence over the request of a data subject;

d. The right to withdraw your consent for the processing, when the processing is consent-based, without prejudice to the legality of the processing conducted until that moment;

e. The right to object to the data processing on the basis of your specific situation, when the processing is performed on the basis of legitimate interest, and to make an objection at any moment to data processing for the purpose of direct marketing, including profiling;

f. The right not to be the subject of a decision made exclusively on the basis of automated processing, including profiling, which has legal effect for the persons who are data subjects or in some other way materially affects the data subject;

g. The right to data transferability, and/or the right to receipt of your personal data which you have provided to the data operator in a structured, usual, machine-readable format, and the right to transfer tihs data to another operator, if the processing is based on your consent or realization of agreement and is realized by automated methods;

h. The right to lodge an appeal to the Data Protection Authority and the right to refer to the competent courts.

Also, if you want to withdraw consent given for the purpose of direct marketing, you will have the right to use the “unsubscribe” option which is available in every marketing communication.
